Course descriptionThe course is designed to introduce students to EC procurement law, its purpose and its application. This will involve a range of topics including the principle of equal treatment of economic operators, the exercise of public authority, distinguished from the carrying on of an economic activity, the distinction between contractual obligation and delegated task, the concept of self-supply and the classification of the activity of a public body by function rather than form. The interaction and possible tensions between economic and social objectives will also be explored.

This course is aimed at those who have studied contract law and competition law previously in their home jurisdiction. However, students taking the course are likely to come from different legal systems, and specifically, legal systems from outside the EU. This being the case, students undertaking the course are not required to have a pass in competition law. They should, however, have a pass in contract law from their home universities. The course will be taught at an intermediate level. The focus will be on EC law but its relationship with WTO public international law will be considered.

Summary of Intended Learning Outcomes
By the end of the course, students should have:

(a) a general understanding of the principles of EC Procurement law and how they interact with national law in the United Kingdom;

(b) a detailed and specific knowledge of particular areas of EC Procurement law within this broader framework;

(c) an understanding of the interaction between economic law, which embodies supranational and international obligations and national issues of administrative law;

(d) developed skills of reading and critical analysis enabling them to analyse the activities of public bodies and relate these to procurement;

(e) developed written and oral skills, including the clear and succinct expression of ideas; and

(f) a basic grounding in research skills and techniques in EC procurement law.
