Course description |
Short description: This course aims to explore the evolution of the law on EU external economic relations, through both successive Treaty amendments and ECJ case-law, including inter alia:
&ˇ EU Competence to Act Externally: legal personality and principle of conferral; express and implied attribution of EU external powers; general objectives/values of EU external economic action.
&ˇ Nature of EU External Economic Competence: exclusive, shared and concurrent powers; relationship between the EU and its Member States in the international economic field; mixed agreements.
&ˇ Institutional/Procedural Aspects: negotiation, conclusion and implementation of international agreements; status of international agreements in the EU legal order; adoption of unilateral measures.
&ˇ Substantive Scope of EU External Economic Competence: Common Commercial Policy, Development and Economic Cooperation Policies; external aspects of other EU economic policies (e.g. EMU, competition).
The course also seeks to look into the practical implementation of the EU external economic relations, by examining a number of bilateral/multilateral agreements concluded by the EU (and its Member States) as well as unilateral measures.
