Summary | An online course designed for students to learn about the range of dispute resolution methods currently deployed in commercial contexts in the UK and internationally.
In response to the need for cost-efficient, timely and appropriate dispute resolution, several methods have been developed taking proceedings outside the usual setting of the courtroom.
This course offers a practical introduction to such dispute resolution methods, including arbitration, adjudication and mediation, as well as online dispute resolution.
Students will analyse the place of dispute resolution in modern society, exploring the laws and rules relating to dispute resolution methods, within the domestic and international legal framework.
The course will take a case study-based approach to focus on pertinent practical issues relating to dispute resolution mechanisms. Students will therefore also consider the potential application and features of different processes and techniques, and evaluate the criteria for selecting between them.
The course consists of ten online learning modules:
1. Arbitration I: the arbitration proceedings
2. Arbitration II: finality of awards and recognition & enforcement of awards
3. Adjudication - construction adjudication
4. Mediation
5. Expert determination
6. Mixed approaches
7. Online dispute resolution I: e-commerce and online ODR
8. Online dispute resolution II: virtual worlds and computer assisted ODR
9. Back to the real world? : Computer assisted ODR - solving offline disputes online?
10. Contemporary issues
Credits from this course can be utilised towards further study on a relevant postgraduate programme at the University of Edinburgh, or at other institutions.

By the end of the course, students will be able to:
* articulate and constructively comment upon the domestic and international legal instruments used to regulate and deliver dispute resolution;
* effectively assess the range of alternative or 'non-court' dispute resolution methods available;
* articulate how and when arbitration, adjudication and mediation processes may be incorporated into practice;
* give a critical account of the role of technology in dispute resolution, and evaluate the potential of online dispute resolution techniques;
* apply advanced research skills in the field of dispute resolution.
