SummaryThis course will offer an insight into the legal framework governing the international carriage of goods. It will analyse the regimes relevant to unimodal and multimodal carriage and examine the carrier¿s, shipper¿s and freight forwarder¿s contractual rights and duties. The following modes will be explored:

- Sea and inland waterway transport;
- Road transport;
- Rail transport;
- Air carriage;
- Multimodal carriage.

The course will explore the applicable legal regimes in form of international transport conventions, national law, standard form contracts and standard conditions and their potential for conflict, particularly in the multimodal context.

With the development of containerisation multimodal transport has grown exponentially, yet the legal framework is based on a piecemeal of unimodal conventions. The resulting legal landscape is complex and requires a thorough overview over all the regimes and their interaction.

Through the use of case studies and primary and secondary literature, the course aims to:

Introduce and consider the legal and practical context in which transportation is taking place;
Introduce and consider the complex legal framework and the industry approaches in form of standard form contracts and conditions to international carriage of goods for the different unimodal types of transport as well as in the multimodal context;
Explore and analyse the relevant laws and rules relating to each of these transport modes and their potential overlap and conflict;
Develop problem solving skills by applying these rules to case scenarios;
Consider the pertinent rules regarding jurisdiction and applicable laws in the field of transport and the resulting problems of forum shopping.

1. Introduction to international carriage of goods I ¿ transportation, freight forwarding, contracts, documents, international trade, cargo insurance.
2. Introduction to international carriage of goods II ¿ international conventions, general framework, research of contracting states
3. Carriage of goods by sea; contracts of affreightment and international conventions ¿ Hague-Visby Rules; CoGSA 1971, CoGSA 1992 and common law
4. Carriage of goods by sea and inland waterways; contracts of affreightment and international conventions ¿ rights and duties in the framework of Hague-Visby, Hamburg and Rotterdam Rules & CMNI
5. Carriage of goods by sea; charterparties and charterparty bills of lading
6. Road and rail carriage framework - CMR and COTIF/CIM
7. Air carriage and its international framework ¿ Warsaw and Montreal Conventions, IATA
8. Multimodal transport ¿ application of transport regimes and difficulties
9. Multimodal transport ¿ Rotterdam Rules and/or other solutions?
10. Conflict of laws in the context of transport
