Learning Outcomes
On completion of this course, the student will be able to:
  1. Mandatory outcomes: (a) Understand the process of a conveyancing transaction, including the land registration process, (b) Understanding the law and practice in relation to missives and be able to draft missive letters and conclude the contract, (c) Examine and report on title in relation to first registration transactions and dealings thereafter, (d) Draft appropriate documents, including a knowledge of LBTT, capital gains tax and inheritance tax, (e) Understand the implications of family law statutory rights on conveyancing transactions and be able to draft and revise relevant documentation, (f) Understand what Searches are required in the Property and Personal Registers, complete the appropriate forms and be able to use ScotLIS, (g) Understand and apply the law on execution of deeds, (h) Appreciate the implications of a secured lender being involved in a conveyancing transaction, (i) Understand what is required before a transaction can settle and be able to manage post settlement issues, including the retention of funds, registration dues and fees, (j) Understand the law and practice in relation to residential leases, including the relevant statutory forms, (k) Understand the law and practice in relation to commercial leases, including relevant documentation and a knowledge of how to complete the relevant documentation such as rent review agreements and licences for work, (l) Have a developing awareness of the digital services of Registers of Scotland and be aware of technology developments affecting the conveyancing process, (m) Understand the law and practice in relation to commercial leases, including relevant documentation and a knowledge of how to complete the relevant documentation such as rent review agreements and licences for work, (n) Have a developing awareness of the digital services of Registers of Scotland and be aware of technology developments affecting the conveyancing process.
