SummaryThis course is divided, approximately equally, between the Law of Trusts and the Law of Succession. The focus is on Scots Law but there will also be a comparative element.
Course description Students will become familiar with an advanced analysis of the law of trusts and succession in Scotland as it is used to transfer and manage wealth during life and upon death. The course is split broadly into two parts. The first considers the core policy objectives and doctrines of the law of succession in Scotland, and will consider some examples of comparative law, particularly mixed and common law jurisdictions, where appropriate. The second considers advanced topics in the administration and organisation of trust law in Scotland, as well as the conceptual nature of the Scottish trust; this part of the course will take account of some comparative developments in onshore and offshore jurisdictions of the Anglo-common law world, as they inform an understanding of Scots law and the policy issues with which it is concerned.
