SummaryThis IP Law in Business elective course aims to provide students with a practical approach and hands-on learning experience in relation to intellectual property law to understand how to identify, protect, exploit and manage business ideas, creations, innovations and brands in a commercial business context. It also aims to equip students to assess and deal with disputes relating to infringement of IP rights, including through formal litigation and less formal alternative approaches to IP protection.
Course description The objective of the course is to enhance your legal skills and knowledge in this area of the law. It also aims to enhance and consolidate your knowledge, understanding and personal reflection on the Law Society of Scotland's PEAT 1 Mandatory and Core Outcomes, which you have already experienced and shall continue to experience on the Diploma core courses.


In particular, by the end of the IP elective, you should be confident that you will be able to:

- understand the role of an IP lawyer;
- identify the main types of IP and appreciate their use in a business context;
- consider how the various IP rights are protected, interact and can be managed;
- explore how IP rights are commercialised and analyse key terms of commercial agreements;
- consider tactics to deploy against potential infringers and strategies for dealing with infringement;
- consider when court action might be appropriate to stop infringement of IP rights, the remedies available and the risks involved;
- understand the tests that must be satisfied for the grant of an interim interdict;
- appreciate opportunities and challenges for IP in the digital age.

Additional Information (Assessment) The Intellectual Property Law in Business elective is assessed by continuous assessment. Students will receive a percentage mark for the whole course. This year, the course is assessed as follows:«br /»

35% is based on class performance (including a contribution to an online discussion forum for IP in the News);«br /»
20% is based on the student¿s presentation on a chosen business;«br /»
21% is based on the student¿s performance in written and oral advocacy in an application for interim interdict; and«br /»

The lead tutor assesses the most appropriate methods of assessment for each academic year, so the balance of these assessments may vary.
Feedback Feedback is provided to student in various forms. Students will receive verbal feedback from tutors on in-class presentations, general comments on class assignments when these are handed back in class and, in general, on class performance, mainly looking at the class as a whole. Students also receive specific written feedback on assignments, where necessary.

On completion of this course, the student will be able to:
