| Course description |
This course will examine the circumstances in which Scots law will hold a party liable for wrongful conduct, the remedies which the person wronged has and the rules limiting the availability of these remedies. In particular, it will address why wrongful conduct generates obligations, who can be liable for such conduct, identify the differing effects of the various remedies and the particular conditions for their availability, and defences which bar their availability. Students will engage in critical analysis of the Scots rules in light of broader debates around the nature of obligations in tort/delict. - Outline the remedies which Scots private provides in respect of wrongful conduct and the limitations on their availability
- Engage deeply with case law and secondary literature on these topics.
- Assess the extent to which these rules respond appropriately to the wrongs which have been done.
- Relate these rules to the conceptual framework of primary and secondary rights and duties
- Present their arguments on these topics accessibly and rigorously
