Learning Outcomes
On completion of this course, the student will be able to:
- Mandatory outcomes: (a)Demonstrate an understanding of the process of a conveyancing transaction; (b) Demonstrate an understanding of the law and practice in relation to missives and be able to draft missive letters and conclude the contract; (c) Examine and report on title in relation to first registration transactions and dealings thereafter; (d) Draft appropriate documents, including a knowledge of LBTT, capital gains tax and inheritance tax; (e) Demonstrate an understanding of the implications of family law legislation on conveyancing transactions and be able to draft and revise relevant documentation; (f) Demonstrate an understanding of what Searches are required in the Property and Personal Registers, complete the appropriate forms and be able to use Scot LIS; (g) Understand and apply the law on execution of deeds; (h) Can explain the implications of a secured lender being involved in a conveyancing transaction; (i) Understand what is required before a transaction can settle and be able to manage post settlement issues, including the retention of funds, registration dues and fees; (j) Demonstrate an understanding of the law and practice in relation to residential leases, including the relevant statutory forms; (k) Demonstrate an understanding of the law and practice in relation to commercial leases, including relevant documentation and a knowledge of how to complete the relevant documentation such as rent review agreements and licences for work; (l) Demonstrate an understanding of the digital services of Registers of Scotland and provide examples of technology developments affecting the conveyancing process
