Judicial Protection in the European Community (VS1) (U03588)

Constitutional and Administrative Law of the European Community, from the particular perspective of the European Court of Justice. Composition and jurisdiction of the Court of Justice and Court of First Instance. Court procedure; administrative principles. Forms of action; preliminary references; judicial review; enforcement actions; other actions. Evolution and development of the general principles of EC law. Structural developments; supremacy; direct effect; national remedies and state liability. Evolution of integration; subsidiarity; closer cooperation. EC law and fundamental rights protection. Ideology of the Court and its jurisprudence.

Summary of Intended Learning Outcomes

In fulfilling these objectives, the course aims also to consolidate and deepen intellectual, practical and transferable skills involved in the legal research of Community and Union law acquired at Ordinary level.

By the end of the course the students should be able to:

demonstrate advanced skills of communication, expression, argumentation and debate acquired via seminar participation;

independently produce a piece of research which displays critical understanding, sound analysis and independence of mind, clear and succinct expression of ideas, the ability to pursue an argument with proper care and attention to academic literature;

synthesise material from a broad variety of sources;

and will have developed research skills: library skills, use of databases and appropriate use of Internet resources.

10 page Essay (100%). Format of pages must be as follows:

Margins: All 1 inch (2.54 cm)
Line spacing: 1.5
Footnotes/endnotes font size: 10
Page numbering: All pages should be numbered in the following style: “Page x of x” where the first x represents the current page number, and the second x the total number of pages. Such numbering should appear either at the very top or very bottom of each page.
