Summary | This course will look at a number of recent high profile decisions of the European Court of Human Rights in the context of ongoing debates on the role, functions and limits of the Strasbourg court's jurisdiction and of the European Convention on Human Rights system more generally. |
Course description |
The programme will include an introduction to the European Convention on Human Rights system and to the European Court of Human Rights' approach to the interpretation of the rights in the Convention, with a specific emphasis on the tensions arising between the living instrument doctrine and the principle of subsidiarity. The remaining seminars will focus on recent high profile decisions of the Strasbourg court in the context of ongoing debates regarding its role, functions and the limits of its jurisdiction. Some of the specific topics considered will be climate change, democratic backsliding, human trafficking, the manifestation of religion in the public sphere, migrant rights, armed conflicts and the consequences of austerity.
