| Summary | A substantial amount of the Mental Health (Care and Treatment) (Scotland) Act 2003 is dedicated to dealing with mentally disordered persons (MDOs), who become involved with criminal proceedings. The Mental Health Care and Treatment Act (Part V111) inserts provisions into the Criminal Proceedings Act 1995 (Part V1) for a person who has or appears to have a mental disorder to receive medical treatment at various stages of the criminal justice process (pre-trial, trial, post trial and final disposal). As such there are a number of statutory duties and best practice issues for MHOs involved in working with mentally disordered offenders. In essence the statutory duties placed upon MHOs are the same after someone has been made subject to a Compulsion Order or a Compulsion Order with a Restriction Order, as they are after someone has been made subject to civil detention e.g. Compulsory Treatment Order.
This element of the training will address the relevant law/policy, address issues of risk and consider in detail the role and responsibilities of the MHO

Learning Outcomes
On completion of this course, the student will be able to:
- Apply knowledge and understanding of mental disorder in relation to offending behaviour, in work with mentally disordered persons in the context of the Mental Health (Care and Treatment) (Scotland) Act 2003 and the Criminal Procedures (Scotland) Act 1995.
- Demonstrate knowledge and awareness of issues relating to equality, diversity and social work values.
